Abstract

This work focuses on the analysis of judicial discretion in the juvenile criminal process, exploring the role it plays in decision-making within this differentiated legal system. The relevance of the topic lies in the need for a differentiated approach for minors in conflict with the law, which must be based on their rehabilitation, reeducation, and social reintegration. The main objective is to understand how discretion allows judges to tailor judicial measures to the individual characteristics of the minor, rather than applying fixed and predetermined sanctions as occurs in adult criminal law. The study addresses the Spanish legal framework, particularly the Organic Law 5/2000, which regulates the criminal responsibility of minors. Key concepts such as the best interests of the child, the principle of flexible legality, minimal intervention, and the regulatory aspects governing the juvenile criminal process are analyzed. The analysis contributes to a deeper understanding of how juvenile justice must always respect the rights of the minor and the requirements of the legal system. Additionally, it has been evaluated how the exercise of this discretion can be both beneficial and risky if it does not adhere to solid normative criteria, delving into its limits, practical implications, and the tensions between flexibility and legality.
