Abstract

En este TFG se analiza la autoría y la protección de las obras generadas por inteligencia artificial generativa a partir del marco clásico del Derecho de autor español y europeo, centrado en la exigencia de una creación intelectual humana propia. Examina la problemática específica de estas obras (autoría, titularidad, originalidad y responsabilidad) y el encaje que ofrecen España, la Unión Europea, Estados Unidos, Reino Unido y China, concluyendo que el sistema actual protege razonablemente las obras humanas asistidas por IA, pero resulta insuficiente para los outputs casi automáticos y para el uso masivo de obras como datos de entrenamiento, por lo que se propone aclarar normativamente el papel de la intervención humana, reforzar la transparencia en la minería de textos y datos y valorar figuras específicas de protección y responsabilidad.

This TFG examines authorship and copyright protection for works generated by generative artificial intelligence within the traditional Spanish and European copyright framework, which is based on the requirement of a human intellectual creation. It analyses the specific issues raised by AI‑related works (authorship, ownership, originality and liability) and the solutions adopted in Spain, the European Union, the United States, the United Kingdom and China, concluding that while the current system can still protect human works assisted by AI, it is insufficient for almost fully automated outputs and for large‑scale use of protected works as training data, and therefore calls for clearer rules on significant human contribution, stronger transparency in text and data mining and tailored forms of protection and liability.
