Análisis constitucional de la utilización de mecanismos de edición genética para la corrección de enfermedades en embriones humanos

Abstract

El avance de las tecnologías de edición genética, especialmente la técnica CRISPR-Cas9, ha abierto un mundo de posibilidades en el ámbito biomédico, permitiendo a los profesionales soñar con la corrección de enfermedades genéticas en embriones humanos. Este desarrollo plantea importantes desafíos jurídicos y éticos, especialmente en el contexto del Derecho Constitucional. El presente trabajo tiene como objetivo analizar, desde una perspectiva constitucional, la utilización de mecanismos de edición genética para la corrección de enfermedades en embriones humanos, considerando tanto el marco normativo nacional como los tratados internacionales de Derechos Humanos. Así, se analizarán los límites constitucionales a la intervención sobre el genoma humano, además de las garantías previstas para la protección de las generaciones futuras. El estudio también pretende plantear algunas reflexiones acerca del equilibrio entre el progreso científico y la protección de Derechos Fundamentales, buscando contribuir al debate sobre la legitimidad y los límites de la edición genética.The advancement of genetic editing technologies, particularly the CRISPR-Cas9 technique, has opened up a world of possibilities in the biomedical field, enabling professionals to envision the correction of genetic diseases in human embryos. This development raises significant legal and ethical challenges, especially within the context of Constitutional Law. The present study aims to analyze, from a constitutional perspective, the use of genetic editing mechanisms for the correction of diseases in human embryos, taking into account both the national regulatory framework and international human rights treaties. Accordingly, the constitutional limits to interventions on the human genome will be examined, as well as the safeguards established for the protection of future generations. This study also seeks to offer some reflections on the balance between scientific progress and the protection of fundamental rights, with the aim of contributing to the debate regarding the legitimacy and limits of genetic editing.
