Estudio crítico del Reglamento Bruselas II bis y su propuesta de refundición de 2016 en materia de responsabilidad parental

Abstract

El trabajo analiza un avance en el reconocimiento del interés superior del menor y en cuanto a su derecho a ser oído. Esto es, tanto a nivel interno como a nivel europeo. A partir de eso, vemos que hay una mejor consideración de estos dos derechos del menor a nivel europeo con la entrada en vigor del Reglamento Bruselas II bis y una profundización de éstos en la propuesta de refundición de 2016 hecha por la Comisión europea, en materia de sustracción internacional. Éste es un tema que afecta a la protección del menor. Y el trabajo permite ver cómo la figura del menor es tomada en consideración en ambos textos.

Si bien el Reglamento toma en consideración al menor, la propuesta de 2016, mediante una agilización de la redacción del Reglamento y, mediante la modificación e introducción de nuevas medidas, mejora el reconocimiento de los derechos del niño a nivel europeo.The work analyzes an advance in the recognition of the best interest of the minor and in his right to be heard. This is, both internally and at European level. From this, we see that there is a better consideration of these two rights of the child at European level with the entry into force of the Brussels IIa Regulation and a deepening of these in the 2016 recast proposal made by the European Commission, in of international abduction. This is an issue that affects the protection of the child. And the work allows to see how the figure of the minor is taken into consideration in both texts.

Although the Regulation takes the minor into consideration, the 2016 proposal, by streamlining the drafting of the Regulation and, through the modification and the introduction of new measures, improves the recognition of children's rights at European level.
