dc.description.abstractLa inteligencia artificial ganará importancia en la contratación, ya sea como objeto del contrato, como una característica de dicho objeto, o como herramienta utilizada para cumplir con obligaciones. En este capítulo se proponen dos líneas de análisis sobre el principio de conformidad, que puede ser de crucial importancia en el nuevo escenario. En primer lugar, la conformidad podría romper sus límites actuales y convertirse en un supra-concepto en el Derecho de obligaciones, un punto de referencia conceptual para determinar si se ha producido un incumplimiento contractual. Esto podría ser útil, teniendo en cuenta el crecimiento de la "servitización" y las obligaciones de medios, que no son el ámbito tradicional del principio de conformidad. En segundo lugar, en un contexto dinámico y en constante evolución, los requisitos legales de conformidad más estrechamente relacionados con el contrato probablemente deberían tener un papel predominante sobre los de naturaleza objetiva. Estos últimos parecen desalentar la innovación, y el progreso tecnológico dificulta su aplicación, creando así incertidumbre.es-ES
dc.description.abstractArtificial intelligence will gain importance in contracting, be it as the object of the contract, as a characteristic of such object or as a tool used to perform obligations. This chapter proposes two lines of analysis regarding the principle of conformity, which may be of crucial importance in the new scenario. First, conformity could break its current boundaries and become a supra-concept in the law of obligations, a conceptual benchmark to determine whether there has been a contractual non-performance. This might be useful, considering the growth of ‘servitisation’ and obligations of means – not the traditional field of the conformity principle. Second, in a dynamic and ever-evolving context, the legal requirements for conformity more closely related to the contract should probably have a predominant role over those of objective nature. The latter seemingly discourage innovation, and technological progress makes it harder to apply them, thus creating uncertainty.en-GB
