Abstract

The loss of legislative power to the executive is a complex phenomenon that has been the subject of analysis and debate in various political systems throughout history.

This imbalance, often associated with excessive concentration of authority in the executive branch, raises important questions about the separation of powers and the healthy functioning of a democratic system.

Historically, this dynamic has been fueled by factors such as political crises, national emergencies or the strengthening of charismatic leaderships. The transfer of power to the executive can manifest itself in a variety of ways, including the expansion of presidential powers, the centralization of decision-making and the weakening of checks and balances by the legislature.

This phenomenon poses significant challenges to accountability, transparency and the ability of the legislature to act as an effective counterweight to the executive branch. The concern lies in the risk of eroding democratic foundations by undermining the legislature's ability to represent and safeguard the interests of society. The issue becomes more complicated when the matter is transferred to the judiciary, as we are currently seeing happening in several Western countries. It seems that the executive has not taken kindly to the expansive vision of supervision of the executive work that the judiciary has carried out, fortunately, throughout the twentieth century.

We are currently witnessing a real setback in the struggle for the immunities of power[1]. It would not be desirable to undo the path and lose in one fell swoop what we have worked so hard to achieve.

Analyzing this imbalance in favor of the executive over the other two branches of government requires a thorough understanding of the specific political contexts, as well as a critical examination of the circumstances that allow or encourage the loss of power of the legislature, fundamentally, but of the judiciary as well. The search for effective solutions implies the strengthening of democratic institutions, the promotion of legislative and judicial independence, and constant vigilance to ensure an adequate balance between the three branches of government.
