El Gobierno en funciones: análisis de la regulación española y del Derecho comparado

Abstract

El Gobierno en funciones es el organismo al que el Derecho confía la dirección del poder ejecutivo del Estado a título provisional, desde el momento del cese del Gobierno anterior, a fin de dotar de continuidad a este órgano político durante el tiempo que precisa el Parlamento para investir a un nuevo Presidente. En el caso de España, el Gobierno en funciones coincide con el Gobierno cesante, aunque se le imponen una serie de limitaciones a la actividad que puede ejercer normalmente. En esta investigación se analizará sistemáticamente la regulación del Gobierno en funciones en el ordenamiento español y de las limitaciones que se le imponen, se completará con referencias al Derecho constitucional comparado, y a la luz de los pronunciamientos doctrinales y jurisprudenciales más relevantes.A caretaker government is the organism to which the law entrusts the provisional direction of the executive power of the State, from the moment in which the preceding government ceases, in order to ensure the continuity of this political institution while Parliament elects a new President. In the case of Spain, the caretaker government is the outgoing Government, although with a set of restrictions on the functions it may normally exert. This paper will systematically analyze the regulation of the caretaker government in Spanish law and the restrictions which are imposed thereon, coupled with references to comparative constitutional law, and in light of the most relevant scholarly opinion and court rulings.
