Abstract
The ability of children to act as new active subjects of rights and freedoms is one of the most difficult conflicts that the legal operator must face, especially when such conflicts arise in the field of medical treatment, where values and interests to protect are especially transcendent. The radical difficulty, severely, in the progressive nature of the child's ability and, in many cases, not absolutely homogeneous from some minors to others. The scientific and legal debate about opting for an objective criterion (age) or subjective (maturity) is not yet closed, although it has been considered for several decades. In addition, in the resolution of stories conflicts arise different doubts and problems, not only derived from the complexity of operating with somewhat diffuse legal principles such as the best interests of the minor, or by the role that in decision making should be granted to parents , but, above all, by the new scientific evidences that arise under the protection of brain imaging studies, through, among others, the behavioral neurology that questions the paradigm offered by evolutionary psychology with the that we have been operating traditionally in the legal field. In short, this work aims to address a complete, systematic, practical and, above all, updated ability to act for minors in the field of medical treatment. It is a work that can be of interest and usefulness not only for jurists but also for those who operate with minors in the health field or similar fields or who have an interest in approaching the child's ability to act from branches of knowledge not strictly legal
