Se debate la crucial distinción jurídico-mercantil entre valores negociables como lista abierta de instrumentos financieros y los productos derivativos como instrumentos financieros distinguibles de los valores negociables por sus características de contratación, especialmente en el caso de instrumentos estándar, pero también en el caso de los OTC

The author sets hypothesis on the relevant distinction between traded securities (according to the Spanish Capital Markets Law) and other financial instrumentos like derivative products, in particular when these are traded on a standard basis in organised market, but also in the case ot the OTC products regulated by the aforementioned laws.
