Derecho real de servidumbre : desafíos regulatorios y problemáticas que plantea el actualrégimen jurídico

Abstract

Este trabajo analiza el derecho real de servidumbre en profundidad, tanto en el Código Civil, como en legislación especial. Habiendo estudiado el régimen jurídico actual, se realizan seis críticas u observaciones, cuya consideración se espera que pueda adaptarse mejor con la coherencia de la figura. En este sentido, la servidumbre, como límite al derecho de propiedad, se basa en la presunción de libertad de cargas de fundo y en la necesaria utilidad de la servidumbre, principios entorno a los cuales debe construirse este derecho y sobre los que giran las críticas u observaciones.This work analyzes the real right of servitude in the Spanish legal system, both in the general and special laws. Having analyzed the framework in which the mentioned right functions, six critics or observations are made in order to suggest a greater coherence for the figure. The real right of servitude, as a limit to property is based on the principles of presumption of freedom from property charges and the necessary usefulness of the easement, principles on which critics or observations are built.
