La impronta histórica del modelo de intervención pública en el cooperativismo español

Abstract

El actual modelo de intervención administrativa en las sociedades cooperativas no puede desgajarse de los antecedentes históricos de los que trae causa. Sin embargo, la doctrina de Derecho administrativo ha prestado escasa atención al cooperativismo español, siendo éste estudiado preferentemente por disciplinas como el Derecho Mercantil o el Derecho del Trabajo. Tal vez por ello, los análisis tienden a olvidar que la intervención pública en las cooperativas no puede analizarse al margen del modo en que el poder público interviene social y económicamente en cada momento histórico, sin perjuicio de las singularidades que pueden encontrarse y cuyas causas es preciso explorar. En el análisis de los antecedentes históricos se advierte que las distintas etapas están marcadas por el factor ideológico que traza no sólo los vaivenes normativos, sino también el distinto trato que recibe el cooperativismo según su sector de actividad. Con todo, el origen histórico demuestra que el esqueleto de la normativa cooperativa se ha mantenido en el tiempo, entremezclando elementos tuitivos y de fomento que tratan de compensarse con componentes de intensa intervención. Los propios antecedentes explican también que la legislación cooperativa quedara extramuros de la mercantil. Un hecho que extiende sus efectos hasta la actualidad, sirviendo de fundamento a la asunción competencial de la “materia” cooperativa por las Comunidades Autónomas, cuya regulación perpetúa el modelo de presencia pública en estas sociedades.

The current model of public intervention in cooperative societies cannot be detached from the historical antecedents of which it causes. However, the studies of public law has paid little attention to Spanish cooperativism, this being preferentially studied by disciplines such as Commercial Law or Labor Law. Perhaps for this reason, the analyzes tend to forget that public intervention in cooperatives cannot be analyzed independently of the way in which public power intervenes socially and economically in each historical moment, without prejudice to the singularities that can be found and whose causes are need to explore. In the analysis of the historical antecedents, it is noted that the different stages are marked by the ideological factor that traces not only the regulatory fluctuations, but also the different treatment that cooperativism receives according to its sector of activity. However, the historical origin shows that the skeleton of the cooperative regulations has been maintained over time, intermingling protective and promotional elements that try to compensate with components of intense intervention. The antecedents themselves also explain that the cooperative legislation remained outside the commercial walls. A fact that extends its effects to the present day, serving as a basis for the assumption of competence of the cooperative "matter" by the Autonomous Communities, whose regulation perpetuates the model of public presence in these societies.
