Los herederos ante el seguro de vida del causante. Derechos y obligaciones

Abstract

Este trabajo analiza la posición jurídica de los herederos del causante frente a la prestación de un seguro de vida para caso de fallecimiento, desde la perspectiva del Derecho de sucesiones. Parte de una paradoja: el seguro de vida cumple una función materialmente sucesoria —transmite riqueza con ocasión del fallecimiento—, pero el ordenamiento lo configura como un derecho propio del beneficiario, nacido del contrato y ajeno a la herencia. La hipótesis que se defiende es que esa disociación entre la realidad económica y la calificación jurídica genera fricciones con el sistema de legítimas y con la responsabilidad patrimonial del causante, fricciones que el artículo 88 de la Ley de Contrato de Seguro resuelve solo de forma parcial e indirecta: mediante el reembolso de las primas, y no la integración del capital en el caudal relicto. Con el método jurídico propio del Derecho civil —análisis normativo, examen de la jurisprudencia y discusión doctrinal—, el estudio aborda la naturaleza del beneficio, la separación entre la herencia y la prestación, las reglas de designación del beneficiario, los conflictos con la legítima (computación, imputación y colación), la posición de los acreedores del causante y de la sociedad de gananciales, y la dimensión procesal del cobro. Se concluye que la protección que el ordenamiento ofrece a herederos y legitimarios frente al seguro de vida es estructuralmente débil, porque alcanza a las primas y no al capital. Se propone, en consecuencia, computar las primas para el cálculo de la legítima y una reforma que clarifique su tratamiento.This paper analyses the legal position of the deceased’s heirs in relation to the proceeds of a life insurance policy payable upon death, from the perspective of succession law. It starts from a paradox: life insurance performs a materially succession-related function — it transfers wealth upon death — yet the legal system characterises it as a right belonging directly to the beneficiary, arising from the contract and separate from the estate. The hypothesis defended is that this dissociation between economic reality and legal classification creates tensions with the forced heirship system and with the deceased’s patrimonial liability, tensions which Article 88 of the Spanish Insurance Contract Act resolves only partially and indirectly: through the reimbursement of premiums, rather than by including the insured capital in the estate.

Using the legal method characteristic of civil law — normative analysis, examination of case law, and doctrinal discussion — the study addresses the nature of the benefit, the separation between the estate and the insurance proceeds, the rules governing the designation of the beneficiary, conflicts with forced heirship rights (calculation, allocation and collation), the position of the deceased’s creditors and of the marital community property regime, and the procedural dimension of collection.

It concludes that the protection afforded by the legal system to heirs and forced heirs in relation to life insurance is structurally weak, because it extends to the premiums but not to the insured capital. Accordingly, it proposes that premiums be included for the purpose of calculating forced heirship rights, as well as a legislative reform clarifying their legal treatment.
