Seguro y tecnología. El impacto de la digitalización en el contrato de seguro

Abstract

A día de hoy pocas cuestiones y menores ámbitos despiertan la atención del jurista como el impacto del desarrollo tecnológico, la digitalización expansiva que estamos viviendo, sobre todo desde este último quinquenio y que está implosionando en cualquier actividad del ser humano. Prácticamente no hay hoy día discurso ni aproximación de algún tipo al mundo del seguro tampoco a cualquier otro mercado sin que se hable o referencie un término con pretensión de globalidad, Insurtech. Sin duda, hoy, lo -tech lo inunda y lo devora todo, y cómo no, en lo legal, en lo regulatorio, en los mercados. Con pretensión holística, tal vez desbordante, Insurtech es un concepto enucleador, atrapalotodo o término paraguas, pero sin que seamos conscientes del significante, tampoco del continente real sobre el que se proyecta o, incluso, se proyectará. Y en esa pretensión, cuál si fuere una intersección o una relación cuasi binaria perfecta, al menos de momento, la cadena de bloques blockchain y el contrato inteligente smart contract no escapan ni al interés tecnológico ni menos al académico y práctico. Como tampoco lo hace el exponente más significativo de esta ya singularidad tecnológica, la robótica y su interrelación con el derecho. Y menos al seguro, ya sea como contrato, ya en su dimensión de distribución, ya sea en su estructura cual actividad aseguradora. Y es ésta intersección, la tecnología y el derecho, la que está despertando toda una eclosión de estudios, de análisis y aproximaciones desde las ciencias. Un marco, el tecnológico llamado a transformar radicalmente formas, técnicas y canales, pero que se encuentra ahora mismo en medio de un escenario de transición entre lo tradicional y lo digital, lo conocido por todos y lo disruptivo solo dominado por unos pocos. Y lo hará además, con una fuerte impronta competitiva entre aseguradores y distribuidores. Una transición a la que se adaptan los viejos esquemas de negocio, de creación y oferta de productos, de distribución y canales de venta múltiples omnicanalidad ante empresas que irrumpen con nuevas formas, a menores costes, y con un conocimiento de las necesidades de consumidores y clientes a través del análisis de datos e información nunca tan accesible como hasta el momento.Nowadays, few questions and lesser areas attract the attention of the jurist, such as the impact of technological development, the expansive digitalization that we are experiencing, especially since the last five years and that is imploding in any activity of the human being. Undoubtedly, today, it is flooded and devours everything, and of course, in the legal, regulatory and market areas. With a holistic pretension, perhaps overflowing, Insurtech is an enucleating concept, a catch-all or umbrella term, but without us being aware of its significance, nor of the real continent on which it is projected, or even will be projected. And in this pretension, what if it were an intersection or a quasi-binary perfect relationship, at least for the time being, the chain of blocks -blockchain- and the intelligent contract -smart contract- do not escape either technological interest or the academic and practical one. Neither does the most significant exponent of this already technological singularity, robotics and its interrelationship with law. And even less to insurance, either as a contract, or in its distribution dimension, or in its structure as an insurance activity. And it is this intersection, technology and law, that is awakening a whole eclosion of studies, analyses and approaches from the sciences. A framework, the technological one, called to radically transform forms, techniques and channels, but which is now in the midst of a scenario of transition between the traditional and the digital, the known by all and the disruptive only dominated by a few. And it will do so, with a strong competitive edge among insurers and distributors.
