Abstract

Apart from the cases where the presence of an advocate is required (c.1481, §§2 and 3), canon law allows the parties to plead and respond personally in the process, unless the judge considers the services of a procurator or advocate to be necessary. Taking into account the wide discretion of the judge in matrimonial cases, the author points out the criteria to be considered in the judge s decisión to allow or deny the litigating parties self-defense. These criteria are deduced from the analysis of the Code of Canon Law and the Instruction Dignitas Connubii, and also from the procedural principle of equality between the parties, since the present canonical norms introduce important differences between the private party who stands before the court by itself and the one who is defended by a lawyer. After this analysis, the author concludes that self-defense of the litigant parties - specially, plaintiff s self-defense - is possible, but is not recommended because the part would have not proper defense due to lack of appropriate technical knowledge and because of the problems that this self-defense may cause to an appropriate development of the procedure. The role of canonical lawyers must be revalorized, considering the importance of their function in the process, and in defense of the rights of the parties.
