Abstract

La entrada analiza el principio de nulla poena sine lege como garantía central de la legalidad penal y del Estado de derecho. Explica su evolución histórica desde sus antecedentes remotos hasta su formulación moderna, vinculada a Feuerbach y a las exigencias de ley previa, escrita, estricta y cierta. A partir de una metodología comparada, estudia cómo se aplica el principio en Estados Unidos, Reino Unido, Alemania y Argentina, mostrando convergencias y divergencias entre tradiciones de common law y civil law. El texto presta especial atención a los problemas que plantea la persecución de crímenes internacionales y de graves violaciones de derechos humanos en contextos de justicia transicional. La autora concluye que, aunque el principio es universalmente reconocido, su alcance práctico depende de la estructura constitucional, la historia jurídica y las tensiones entre seguridad jurídica y justicia retrospectiva.The entry examines the principle of nulla poena sine lege as a core guarantee of criminal legality and the rule of law. It traces the principle’s historical evolution, from early antecedents to its modern formulation associated with Feuerbach and the requirements of prior, written, strict, and certain law. Using a comparative methodology, the article studies how the principle operates in the United States, the United Kingdom, Germany, and Argentina, highlighting convergences and divergences between common law and civil law traditions. Particular attention is given to the difficulties posed by the prosecution of international crimes and serious human rights violations in transitional justice contexts. The author concludes that, although the principle is universally recognized, its practical scope varies according to constitutional structure, legal history, and the tension between legal certainty and retrospective justice.
