Abstract

During the XIX century a penal codification took place in Spain, culminating in the creation of the penal code of 1822, 1848 and its subsequent reform in 1850 and the Code of 1870. In these texts, kidnapping was regulated under the category of “sexual offenses”. This crime has proven difficult to classify because certain ambiguities’ existence in the penal codes’ regulation. This is the reason why the doctrine and jurisprudence tried determining its concept and effects throughout the late XIX century and early XX century. Because this crime was considered to be a sexual offence against women’s honor, the criminal’s exoneration could be obtained through the victim’s pardon. This pardon could many times result in the marriage between kidnapper and kidnappee. The doctrine questioned this modality of exoneration, because of its doubtful morals and its outdated nature in a rapidly changing society.
