El sistema español de apoyos a la capacidad como modelo exportable al Derecho chileno

Abstract

Con el presente Trabajo de Fin de Grado pretendo estudiar y analizar la incidencia de la Convención Internacional sobre los Derechos de las Personas con Discapacidad de Naciones Unidas hasta la fecha, tanto en el ordenamiento jurídico español como en el ordenamiento jurídico chileno. De este modo, a través del análisis de las diferentes innovaciones jurídicas, trataré de concluir en qué medida puede ser el modelo de apoyos español, una inspiración para el modelo de discapacidad chileno, abordando la necesidad de adecuar la legislación nacional chilena a lo que dice en relación con la capacidad jurídica con la Convención.With this Final Degree Project I intend to study and analyze the impact of the United Nations International Convention on the Rights of Persons with Disabilities up to today’s date, both in the Spanish legal system and in the Chilean legal system. Thus, through the analysis of the different legal innovations, I will try to conclude to what extent the Spanish system of supports can be an inspiration for the Chilean model of disability, addressing the need to adapt the Chilean national legislation to what it says in relation to legal capacity with the Convention.
