Abstract

La propuesta de Ley sobre bienestar animal, que las Cortes Generales van a aprobar, así como la reciente modificación del Código Civil, ha creado una categoría nueva en nuestro Derecho, ya existente en otros ordenamientos, para referirse a los animales no humanos como seres sintientes. En este artículo se intentará analizar si esta categoría es o no adecuada para su protección y la consideración que los animales deberían tener de acuerdo a su correcto reconocimiento de derechos: si como meros pacientes morales o también como agentes morales.The proposed Law on animal welfare, which the Cortes Generales is going to approve, as well as the recent modification of the Civil Code, has created a new category in our Law, already existing in other legal systems, to refer to non-human animals as sentient beings. . This article will try to analyze whether or not this category is adequate for their protection and the consideration that animals should have according to their correct recognition of rights: whether as mere moral patients or also as moral agents.
