Protección patrimonial del discapacitado. Especial referencia al patrimonio protegido

Abstract

Con el presente trabajo se pretende estudiar la protección patrimonial de los discapacitados. Aunque la terminología en este ámbito ha sido cambiante y ha suscitado dudas desde la Ley 41/2003, de 18 de noviembre, de Protección Patrimonial de las Personas con Discapacidad, el Derecho español cuenta con un más preciso concepto legal de discapacitado; asimismo, la citada ley reguló un conjunto de instrumentos y técnicas de protección patrimonial de los mismos, entre los que destaca el patrimonio protegido. Éste constituye el objeto principal de este trabajo; además se analiza la figura anglosajona del trust comparándolo con el citado patrimonio protegido de nuestro ordenamiento jurídico español.The aim of this paper is to study the patrimonial protection of the disabled. Although the terminology in this field of study has been changing and has raised doubts since the law 41/2003, of 18 November, on the Patrimonial Protection of people with disabilities, Spanish Law has a more acurrate legal concept of disabled; also, the law mentioned before has regulated a group of instruments and techniques of patrimonial protection for them, in which stands out the protected patrimony. This constitutes the principal aim of this study; in addition it´s analysed the Anglo- Saxon figure of the trust comparing it with the protected patrimony of our Spanish legal system mentioned before.
