dc.description.abstractEl presente trabajo analiza la protección constitucional y jurídica de los menores influencers en redes sociales, atendiendo especialmente a los derechos a la intimidad, a la propia imagen, a la protección de datos personales y al libre desarrollo de la personalidad. La actividad de estos menores se sitúa en un espacio complejo, en el que confluyen ocio digital, exposición pública, monetización de la imagen y tratamiento intensivo de datos personales. A partir de esta realidad, se estudia la afectación de sus derechos fundamentales y el papel del interés superior del menor como criterio de ponderación. Asimismo, se examina la insuficiencia del marco jurídico español actual y la reciente propuesta gubernamental sobre protección de menores en entornos digitales. Finalmente, el trabajo plantea la necesidad de una regulación específica del menor influencer, basada en una definición jurídica propia, mecanismos de control previo, obligaciones para plataformas, marcas y agencias, y un derecho reforzado del menor a la retirada y desvinculación de contenidoses-ES
dc.description.abstractThis paper analyses the constitutional and legal protection of child influencers on social media, with particular focus on the rights to privacy, image rights, personal data protection and the free development of personality. The activity of these minors occupies a complex legal space in which digital leisure, public exposure, monetisation of image and intensive data processing converge. On this basis, the paper examines the impact of this activity on minors’ fundamental rights and the role of the best interests of the child as a key balancing criterion. It also studies the insufficiency of the current Spanish legal framework and the recent governmental proposal on the protection of minors in digital environments. Finally, the paper argues for a specific regulation of child influencers, based on a separate legal definition, prior control mechanisms, obligations for platforms, brands and agencies, and a reinforced right of the minor to request the removal of, and disassociation from, contenten-GB
