Instituciones de inversión colectiva: La situación actual de las SICAV en España

Abstract

El presente Trabajo de Fin de Grado tiene como objetivo estudiar la situación actual de las Sociedades de Inversión de Capital Variable (SICAV) en España. Estos vehículos de inversión se encuentran en profundo declive; por tanto, es necesario determinar las causas que motivan tal situación, pese a su consideración como un vehículo atractivo de inversión. Este tipo de sociedades están enmarcadas dentro de las Instituciones de Inversión Colectiva. En primer lugar, se partirá de una visión general de las Instituciones de Inversión Colectiva para, posteriormente, ahondar en la figura de las SICAV; se realizará un análisis exhaustivo de la normativa aplicable que determina su funcionamiento y se establecerán sus características y ventajas tanto económico-financieras como fiscales, que las hacen más atractivas con respecto a métodos alternativos de inversión. Una vez determinados sus aspectos fundamentales, se realizará un estudio de la volátil e inestable trayectoria histórica de las SICAV en España, tomando como período de referencia desde la década de los 90, momento en el cual comienza el verdadero despegue de estas sociedades en España, hasta la actualidad, momento en el cual la situación política está desembocando en un éxodo masivo de estas sociedades: se analizará cómo han experimentado tanto épocas de gran auge y crecimiento como momentos de depresión e impopularidad, como es el caso actual, y se determinarán las causas que han generado este comportamiento. Se hará énfasis en la gran controversia y polémica que siempre han generado, al ser concebidas como “instrumentos al servicio de las grandes fortunas españolas para la gestión de su patrimonio”. A continuación, se observará como todos estos hitos quedan perfectamente plasmados en la evolución del número de sociedades registradas, su patrimonio, la composición de su cartera interior y exterior, y se analizarán las expectativas futuras de este tipo de sociedades en nuestro país.

The present End-of-Degree Project pursues the goal of conducting a thorough analysis of the current situation of Investment Companies with Variable Capital in Spain. These investment instruments currently experience a relevant depression; therefore, we need to as determine the drivers of this shift. These companies are considered as an specific type of Collective Investment Schemes. Therefore, a general overview of Collective Investment Schemes will be provided in order to develop, hereunder, a deep analysis of Investment Companies with Variable Capital; we will study the applicable regulation which determines their performance, as well as establishing their characteristics and their tax, economic and financial advantages, which make them attractive instruments against other investment options. Once their fundamental features have been determined, we will proceed to study their volatile and unstable track record in Spain between the 90’s, period in which these societies experience their relevant growth, and present years; currently, these societies suffer a massive outflow due to the political framework: we will analyze how Investment Companies with Variable Capital have experienced both periods of expansion and slump, as is happening currently, and we will determine the driving forces that have caused these changes. We will make emphasis on the strong controversy they have always generated due to their conception of “tools serving great Spanish fortunes with the aim of managing their wealth”. Then, we will observe how all these milestones are perfectly exemplified in the changes of the number of registered societies, their equity, their both inner and outside portfolio’s composition, as well as we will analyze the future expectations of these societies’ development in our country.
