Abstract

Works of art are present in legal and economic transactions. They circulate, are transmitted, are the object of investment, the constitution of guarantees, are lent or sold. And like all objects or res commercium, they are subject to various risks and, of course, to authenticity as a specific risk of their transmission and, therefore, their validity. In spite of the (perhaps apparent) conviction of a certain static nature, even intimacy, few goods like these retain such a vocation for circulation, as well as transcendence and public notoriety when their value reaches exorbitant figures1. On the other hand, a separate issue is that of assets protected by regulations on historical heritage and considered as such, whether as Assets of Cultural Interest, inventoried assets, etc., whether or not, apart from rare exceptions, they are inalienable and at the same time actions for their recovery are not time-barred, and without the third party who has acquired them being able to usucapirise them or appeal against the statute of limitations on acquisition (this is also the case for ecclesiastical and administrative assets
