Abstract

The aim of this paper is to analyse the conduct consisting on the illegal financing of political parties, introduced for the first time in the Spanish legal system by means of the Organic Law 1/2015 of March 30th, which modifies the Organic Law 10/1995 of November 23rd of the Criminal Code. The introduction of this criminal figure in our Criminal Code is a response to a legal loophole suffered by our legal system, given that the cases of illegal financing of political parties were not included among the crimes against the Public Administration, since members of political parties are not civil servants. Its temporary appearance coincides with the recent and frequent appearance of numerous scandals involving the illegal financing of political groups with considerable social and media repercussions (think of the Bárcenas or Gürtel cases), although the debate about the introduction of this crime began at the end of the 20th century with the Filesa case.
