El impacto de la legítima en la libertad de testar: Estudio sobre su regulación en España y comparación con otros ordenamientos jurídicos

Abstract

La legítima constituye en nuestro Derecho sucesorio uno de los principales límites a la autonomía de la voluntad y a la libertad de testar. Su regulación responde a una decisión histórica que optó por reservar una parte de la herencia a determinados herederos forzosos, en línea con nuestra tradición jurídica. A partir de esta base, el trabajo analiza si la configuración actual de la legítima sigue respondiendo a necesidades sociales o si, por el contrario, resulta necesaria una reforma. El trabajo parte de un análisis teórico de la legítima, atendiendo a su naturaleza jurídica, intangibilidad y fijación, con apoyo en su evolución histórica y en los límites que el ordenamiento impone a la libertad de testar. A continuación, se abordará la relación entre la legítima y la pensión de alimentos para valorar si esta pudiera servir como fórmula alternativa que tutele a los familiares que realmente se encuentran en situación de necesidad. Igualmente, se plantea el estudio de los derechos civiles forales y de algunos sistemas extranjeros que permitirán valorar si el modelo del Derecho común sigue siendo el más adecuado. Asimismo, se examinan las principales críticas formuladas frente al sistema de legítimas, el debate en torno a su constitucionalidad y las propuestas doctrinales y jurisprudenciales orientadas a ampliar la libertad de testar. También se abordan algunos mecanismos utilizados para eludir o reducir sus efectos, como muestra de las tensiones que genera el modelo vigente, así como las transformaciones sociales que justifican la necesidad de revisar esta institución. Finalmente, el trabajo concluye con la exposición de posibles reformas en el Derecho sucesorio español.The forced share of an estate constitutes, in our law of succession, one of the main limits on personal autonomy and testamentary freedom. Its regulation reflects a historical decision to reserve part of the estate for certain forced heirs, in line with our legal tradition. On this basis, the paper analyses whether the current configuration of the forced share still responds to social needs or whether, on the contrary, a reform is required. The paper begins with a theoretical analysis of the forced share, focusing on its legal nature, intangibility, and determination, supported by its historical evolution and by the limits that the legal system imposes on testamentary freedom. It then addresses the relationship between the forced share and maintenance obligations in order to assess whether the latter could serve as an alternative mechanism to protect family members who are genuinely in need. It also examines the regional civil law systems within Spain and certain foreign legal systems in order to evaluate whether the model established under the common civil law remains the most appropriate. In addition, it considers the main criticisms directed at the system of forced heirship, the debate surrounding its constitutionality, and the doctrinal and judicial proposals aimed at expanding testamentary freedom. The paper also explores certain mechanisms used to avoid or reduce its effects, as evidence of the tensions generated by the current model, as well as the social changes that justify the need to reconsider this institution. Finally, the paper concludes by presenting possible reforms in Spanish succession law.
