El experto en los planes de reestructuración: Nombramiento y estatuto

Abstract

.La legislación concursal, tras su reforma por la Ley 16/2022, incluye los planes de reestructuración en el ámbito del Derecho preconcursal e incorpora la figura del experto en reestructuración. Este experto debe ser una persona, natural o jurídica, española o extranjera, que tenga los conocimientos especializados, jurídicos, financieros y empresariales, así como la experiencia en materia de reestructuraciones o que acredite cumplir los requisitos para ser administrador concursal.

The insolvency legislation, following its reform by Law 16/2022, includes restructuring plans within the scope of pre-insolvency law and incorporates the figure of the restructuring expert. This expert must be an individual or legal entity, Spanish or foreign, with specialized knowledge in legal, financial, and business matters, as well as experience in restructuring, or must demonstrate compliance with the requirements to be an insolvency administrator.
