Abstract

El trabajo presenta el texto latino, la traducción al español y un comentario jurídico de una sentencia dictada por monseñor Felipe Heredia Esteban, juez auditor del Tribunal de la Rota Romana. La resolución analiza una causa de nulidad matrimonial cuyo título jurídico principal es la simulación del consentimiento mediante un acto positivo implícito de voluntad. El estudio examina los hechos relevantes, las declaraciones de las partes y de los testigos, así como los criterios jurídicos empleados para determinar la existencia de una exclusión voluntaria de elementos esenciales del matrimonio. La traducción facilita el acceso a la jurisprudencia rotal, mientras que el comentario contextualiza la sentencia dentro de la doctrina canónica sobre la simulación, la voluntad matrimonial y la valoración de la prueba en los procesos de nulidad.This work presents the Latin text, Spanish translation, and legal commentary on a judgment delivered by Monsignor Felipe Heredia Esteban, auditor judge of the Roman Rota. The decision concerns a marriage nullity case whose principal legal ground is the simulation of matrimonial consent through an implicit positive act of will. The study examines the relevant facts, the statements of the parties and witnesses, and the legal criteria used to determine whether an essential element of marriage was deliberately excluded.
