Abstract

¿Ha servido de algo la subordinación tan rígida que estableció el legislador concursal y sigue reservando en el TRLC?What is the point of privilege in a scenario where a priori the hypothetical parity in the conflict of interests that beats between creditors is emblazoned, why has the legislator not moved towards a classless bankruptcy or even, at least, vetoed public privilege, given that the public creditor is an asymmetrical creditor with respect to the information it possesses before other ordinary creditors? Has the very rigid subordination established by the bankruptcy legislator and still reserved in the TRLC served any purpose?
