Compatibilidad del arbitraje tributario con el sistema español: estudio comparado con los modelos de la OCDE y la Unión Europea

| dc.description.abstract | El presente estudio tiene por objeto analizar la compatibilidad del arbitraje tributario con el ordenamiento jurídico español, en un contexto en el que la elevada litigiosidad tributaria y la limitada eficacia de los cauces ordinarios de revisión hacen necesario explorar mecanismos alternativos de resolución de controversias capaces de ofrecer respuestas más ágiles, especializadas y eficaces. El estudio examina, en primer lugar, la configuración del arbitraje en el ámbito fiscal internacional, atendiendo al artículo 25 del Modelo de Convenio de la OCDE y a su evolución a través de las Acciones 14 y 15 del proyecto BEPS, así como al sistema previsto en la Directiva (UE) 2017/1852. A partir de este análisis comparado, se aborda la posible implantación de un arbitraje tributario interno en España, considerando sus requisitos constitucionales, legales y procesales, así como las principales objeciones doctrinales formuladas frente a esta figura. El análisis realizado permite sostener que el arbitraje tributario no resulta, en sí mismo, incompatible con los principios de legalidad e indisponibilidad de la obligación tributaria, siempre que exista una habilitación legal expresa y una delimitación precisa de su alcance. Desde esta perspectiva, se propone un modelo de arbitraje de derecho, voluntario para el contribuyente y obligatorio para la Administración una vez activado, configurado como vía alternativa a la económico y contencioso-administrativa, con un laudo vinculante y sometido a un control judicial limitado. De este modo, el arbitraje tributario se presenta no como una solución universal frente a toda conflictividad fiscal, sino como un instrumento útil para mejorar la resolución de determinadas controversias tributarias dentro del sistema español. | es-ES |
| dc.description.abstract | This paper aims to analyze the compatibility of tax arbitration with the Spanish legal system, in a context where high levels of tax litigation and the limited effectiveness of traditional review mechanisms make it necessary to explore alternative dispute resolution methods capable of providing more agile, specialized and efficient solutions. The study first examines the configuration of arbitration in the field of international taxation, focusing on Article 25 of the OECD Model Tax Convention and its evolution through Actions 14 and 15 of the BEPS project, as well as on the system established by Directive (EU) 2017/1852. Based on this comparative analysis, the paper addresses the potential implementation of a domestic tax arbitration system in Spain, considering its constitutional, legal and procedural requirements, as well as the main doctrinal objections raised against this mechanism. The analysis carried out supports the view that tax arbitration is not, in itself, incompatible with the principles of legality and non-disposability of tax obligations, provided that there is an explicit legal basis and a clear delimitation of its scope. From this perspective, a model of legal arbitration is proposed, voluntary for the taxpayer and binding on the Administration once activated, conceived as an alternative to both administrative and judicial review procedures, with a binding award subject to limited judicial control. Thus, tax arbitration is not presented as a universal solution to all tax disputes, but rather as a useful instrument to improve the resolution of certain tax controversies within the Spanish legal system. | en-GB |
