| dc.description.abstract | : El elemento central del comentario está basado en la posibilidad de aplicar la figura del delito continuado en el delito fiscal. Puesto que constituye una ficción legal que quiebra el principio del hecho natural y ontológico, su aplicación es problemática en relación con determinadas figuras delictivas. Por lo que respecta al delito fiscal sus especiales requisitos conllevan que la doctrina y la jurisprudencia mayoritarias en España entienden que no cabe dicha aplicación. En este comentario se expondrán los argumentos a favor y en contra, y se tomará partido a favor de su aplicación, restringida a aquellos casos en que concurran todos los requisitos legales. También se valorará la teoría de la ignorancia deliberada y las críticas que se efectúan de la misma, por cuanto implica una ampliación desmesurada del ámbito de actuación del dolo eventual, y se efectuará una apreciación de la ausencia de acusación de los asesores fiscales | es-ES |
| dc.description.abstract | : The central element of the commentary is based on the possibility of applying the figure of continuous crime in fiscal crime. Since it constitutes a legal fiction that breaks the principle of the natural and ontological fact, its application is problematic in relation to certain criminal figures. As regards tax offenses, their special requirements mean that the majority doctrine and jurisprudence in Spain understand that such an application does not take place. This commentary will set out the arguments for and against, and will be taken in favor of its application, restricted to those cases in which all legal requirements. The theory of deliberate ignorance and criticism of it will also be valued, since it implies a disproportionate extension of the scope of potential fraud, and an assessment will be made of the absence of accusation by tax advisors. | en-GB |
