Novedosos casos de daño moral en la jurisprudencia

Abstract

Delimitación del concepto de daño moral, concepto que reviste gran complejidad debido a su dinamismo. Desde la concepción clásica del término y su clasificación, hasta llegar a lo que hoy consideramos daño moral. Las indemnizaciones percibidas por este tipo de daños, así como su pertinencia y la fijación de su cuantía. El papel fundamental de la jurisprudencia en la evolución del término y su capacidad para adaptarse con gran rapidez a los cambios que requiere la sociedad. Finalmente, se analizan algunos casos novedosos o llamativos como las anticoncepciones fallidas; falsificación de billetes; incidentes en turismo y transporte de viajeros; el incumplimiento de deberes conyugales; plagio de marcas o el derecho al olvido digital.Establishing limits to the concept of moral damages presents a wide range of difficulties due to the concept’s great dynamism. The compensation one can receive for the moral damages suffered, their suitability and quantity has truly changed from the classical point of view to today’s regulation and circumstances. Throughout this study, we will analyse the important role that the jurisprudence has played in the evolution of the concept as time goes by. We must also emphasise its capacity to adapt to the constant changes that today’s society presents. Finally, we will discuss some of the most novel and striking cases of the latest years such as failed contraception, note and bill forgery, tourisms incidents and tourist transportation, breach of marital duties, counterfeiting trademark or right to oblivion in digital matters.
