Protección de los menores víctimas de un delito cometido por otro menor de edad

Abstract

El capítulo analiza la protección de los menores víctimas de delitos cometidos por otros menores dentro del sistema español de justicia juvenil. Examina la tensión entre el interés superior del menor infractor y el de la víctima, destacando la necesidad de ponderar ambos derechos. Se estudia la evolución de la participación de la víctima en el proceso de menores, especialmente tras las reformas de la LORPM y la LOPIVI. Asimismo, se describen las necesidades específicas de las víctimas menores, con especial atención a la prevención de la victimización secundaria. El trabajo analiza mecanismos como la prueba preconstituida, la Cámara Gesell y el modelo Barnahus. Finalmente, identifica problemas de desigualdad territorial, falta de recursos y coordinación institucional, y propone avanzar hacia una justicia juvenil más protectora, especializada y adaptada a la infancia.

The chapter analyses the protection of child victims of offences committed by other minors within the Spanish juvenile justice system. It examines the tension between the best interests of the juvenile offender and those of the victim, emphasising the need to balance both sets of rights. The study reviews the evolution of victims’ participation in juvenile proceedings, particularly following reforms to the Spanish Juvenile Criminal Responsibility Act and the legislation on the comprehensive protection of children against violence. It also addresses the specific needs of child victims, especially the prevention of secondary victimisation. Particular attention is given to pre-recorded evidence, Gesell chambers and the Barnahus model. Finally, the chapter highlights territorial inequalities, insufficient resources and coordination problems, advocating a more protective, specialised and child-friendly juvenile justice system.
