El interés en el contrato de seguro. Ensayo dogmático sobre el interés

Sin duda, el interés, en cualquiera de sus múltiples dimensiones, es, de los elementos del contrato de seguro, el que más interrogantes, dudas y cuestionamientos presenta, mas eso sí, sin merma de su importancia y nervialidad misma en el contrato . Interrogantes incluso que cuestionan frontalmente su categoría misma de esencialidad en el contrato de seguro, máxime en función de los ramos o modalidades asegurativas. Perspectivas que, además, pivotando sobre el interés lo llevan a dimensiones causalistas, objetivas o a relaciones puramente económicas . Cuando no, su auténtica razón de ser y existir. Sirve a día de hoy la justificación del interés ¿en los mismos parámetros que siempre hemos conocido? , ¿debemos por el contrario suprimir su esencialidad y buscar sustitutivos que relajen su carácter de esencial en función del ramo de seguro, cuál es por ejemplo el consentimiento expreso del asegurado, máxime en los seguros de personas? , o tal vez debemos simplemente mudar los anclajes y presupuestos que hasta ahora hemos conocido y que han edificado la construcción dogmática del interés?
