El principio prior in tempore, potior in iure. Origen romano y actual inscripción en el Registro de la Propiedad

Abstract

El presente trabajo tiene como objeto el análisis del principio prior tempore, potior iure: solución a los conflictos que otorga la prioridad al ejercicio del derecho más antiguo en detrimento del nuevo. Tiene por objeto el estudio de la evolución de dicho principio desde su origen romano hasta su actual aplicación en la legislación nacional. Finalmente, por medio del estudio de la inscripción en el Registro de la Propiedad se encuentra una cierta similitud entre el censo romano y el Catastro actual.The following paper analyzes the prior tempore, potior iure: principle the solution to conflicts that gives priority to the exercise of rights to the older one rather than the new. This paper analyzes the evolution of this principle from its origin to its actual application in the national legislation. Finally, when studying the registering in the Real State Registry, a slight simile between the roman census and actual land registry is found.
