| dc.description.abstract | The article examines Luigi Ferrajoli’s guarantist constitutionalism through the gap between the formal recognition of fundamental rights and their effective protection. It explains how constitutional democracy limits majority rule through the so-called sphere of the undecidable and stresses the need for primary and secondary guarantees capable of making rights effective, particularly social rights. The author connects this approach with substantive equality and with the positive duties of public authorities regarding education, healthcare and social protection. The article also discusses the distinction between governmental functions and guarantee functions, as well as the growing influence of private economic and financial powers. Finally, it considers Ferrajoli’s proposal to extend constitutional guarantees beyond the State and develop supranational institutions capable of protecting fundamental rights within a broader model of cosmopolitan democracy. | en-GB |
