La estructura orgánica judicial eclesial. Especial referencia a la Rota de la Nunciatura

Abstract

El documento analiza la estructura orgánica del sistema judicial eclesiástico, con especial énfasis en la organización de los tribunales en la Iglesia Católica. Se abordan aspectos como el ius connubii (derecho al matrimonio) y la tutela judicial efectiva, así como el papel del Romano Pontífice, los obispos diocesanos y los distintos niveles de tribunales (diocesanos, metropolitanos, interdiocesanos y de la Santa Sede). Se destaca el papel de la Rota de la Nunciatura Apostólica en España y la importancia de la jerarquización judicial en la Iglesia para garantizar la administración de justicia y la resolución de causas matrimoniales, especialmente las de nulidad.The document analyzes the organizational structure of the ecclesiastical judicial system, with a particular focus on the organization of courts within the Catholic Church. It discusses aspects such as ius connubii (the right to marriage) and effective judicial protection, as well as the role of the Roman Pontiff, diocesan bishops, and the different levels of courts (diocesan, metropolitan, interdiocesan, and those of the Holy See). The role of the Rota of the Apostolic Nunciature in Spain is highlighted, along with the importance of judicial hierarchy in the Church to ensure the administration of justice and the resolution of matrimonial cases, especially those concerning annulments.
