El derecho real de hipoteca en Roma y su evolución en el derecho civil español actual

Abstract

Este trabajo examina la evolución del derecho real de hipoteca desde sus orígenes en el Derecho romano hasta su forma actual en el Derecho civil español. Comienza con las primeras garantías, como la fiducia y el pignus, para luego analizar el nacimiento de la hypotheca como garantía real sin desplazamiento posesorio. Además, se aborda su desarrollo durante el régimen clásico, su sistematización en la era justinianea, y se presta especial atención a aspectos como la accesoriedad, indivisibilidad, preferencia y persecución del bien, así como a la existencia de pluralidad hipotecaria y privilegios. A continuación, se analiza la influencia del modelo romanista en el Derecho histórico español, especialmente a través de las Partidas, y cómo su importancia cambió en el siglo XIX con la Ley Hipotecaria de 1861 y el Código Civil de 1889, que establecieron la inscripción registral con carácter constitutivo. Finalmente, se examina la configuración y el régimen jurídico actual de la hipoteca en España, resaltando sus características principales (ius distrahendi, especialidad, rango registral, fe pública registral, legitimación y ejecución), y se realiza un análisis comparativo que evidencia las continuidades estructurales y las transformaciones funcionales de la institución en el contexto social y económico presente, marcado por una mayor protección del deudor hipotecario.
This paper analyzes the historical evolution of the real right of mortgage from its origins in Roman law to its current configuration in Spanish civil law. Starting from the earliest forms of security (fiducia and pignus), the study examines the emergence of the hypotheca as a real guarantee without dispossession, its technical consolidation in the classical period, and its systematization in Justinian law, with particular attention to the principles of accessoriness, indivisibility, priority, and the right to pursue the encumbered asset, as well as to multiple mortgages and privileged claims. The paper then explores the reception of the Roman model in historical Spanish law, especially through the Siete Partidas, and its decisive transformation in the nineteenth century with the Mortgage Law of 1861 and the Civil Code of 1889, which introduced the constitutive nature of land registry inscription. Finally, the study examines the current legal regime of mortgages in Spain, highlighting their essential features (ius distrahendi, specialty, ranking, public faith of the Land Registry, legitimacy, and foreclosure), and provides a comparative analysis that reveals both the structural continuities and the functional transformations of the institution in the contemporary socio-economic context, characterized by increased protection of the mortgage debtor.
