Abstract
La gestión eficaz de los conflictos de intereses es fundamental
en una eventual regulación del TPF. Mientras que algunas voces sostienen
que, en todo caso, se debe revelar completamente el contenido del contrato
de financiación, este capítulo aboga por una postura más equilibrada, que
se adapte a las particularidades de cada caso y se centre en manejar de forma
adecuada cualquier conflicto de interés que pueda presentarse en un litigio
o arbitraje.
The effective management of conflicts of interest is fundamental in an eventual TPF regulation. While some voices argue that, in any case, the content of the financing contract should be fully disclosed, this chapter advocates a more balanced position, which is adapted to the particularities of each case and focuses on handling in an appropriate manner any conflict of interest that may arise in a litigation or arbitration.
