Protocolo facultativo relativo a la venta de niños, la prostitución infantil y la utilización de niños en la pornografía

Abstract

Con motivo del reconocimiento del 30 aniversario de la Convención de las Naciones Unidas sobre los Derechos del Niño, este capítulo analiza la implementación y el cumplimiento del Protocolo Facultativo sobre la venta de niños, la prostitución infantil y la pornografía infantil en España. Este trabajo se centra en hacer un análisis de las recomendaciones hechas a España desde el 2002 hasta el 2018. Con este fin en primer lugar se llevará a cabo un análisis introductorio sobre el fenómeno de la explotación infantil, el proceso que llevo a su adopción por las Naciones Unidas y su implementación por parte de la jurisprudencia internacional y regional de Derechos Humanos. En segundo lugar, se pasará a reflejar las observaciones formuladas a España desde el 2002 en adelante, destacando las últimas que datan del 2018. En tercer lugar, ofrecerá un estudio del alcance de los artículos 2 y 3 del Protocolo en derecho internacional, para pasar posteriormente a considerar la implementación por parte de España de dichas recomendaciones. Se concluye destacando que España a través de Reformas legislativas, planes y proyectos demuestra un incremento de la sensibilidad hacia la explotación sexual de la infancia, sin embargo, existen desajustes entre el Protocolo y el Código Penal y se requieren de medidas que sigan sensibilizando, previniendo y detectando estos casos.On the occasion of the recognition of the 30th anniversary of the United Nations Convention on the Rights of the Child, this chapter analyzes the implementation and compliance with the Optional Protocol on the sale of children, child prostitution and child pornography in Spain. This work focuses on making an analysis of the recommendations made to Spain from 2002 to 2018. To this end, first, an introductory analysis will be carried out on the phenomenon of child exploitation, the process that led to its adoption by the United Nations and its implementation by international and regional Human Rights jurisprudence. Secondly, it will reflect the observations made to Spain from 2002 onwards, highlighting the latest ones dating from 2018. Thirdly, it will offer a study of the scope of articles 2 and 3 of the Protocol in international law, to pass subsequently to consider the implementation by Spain of these recommendations. It is concluded by highlighting that Spain through legislative reforms, plans and projects shows an increase in sensitivity towards the sexual exploitation of children, however, there are imbalances between the Protocol and the Penal Code and measures are required that continue to raise awareness, and detecting these cases.
