EL TRABAJO AUTÓNOMO VS. EL TRABAJO POR CUENTA PROPIA: ESTUDIO COMPARATIVO DE LA PROBLEMÁTICA EN ESPAÑA Y EN EL ESTADO DE ILLINOIS (EE. UU.).

Abstract

En este Trabajo de Fin de Grado (“TFG”) se estudia la regulación de los trabajadores autónomos en España y en el Estado de Illinois (EE. UU.). Tiene como objetivo analizar las notas de la relación laboral, así como la regulación del trabajador autónomo, enfocado a una realidad existe en el mundo actual: las start-ups que ofrecen productos y servicios a través de diferentes intermediarios (Glovo o Uber, entre otras).

Para ello, se ha estudiado y comparado la regulación laboral desde dos perspectivas diferentes: la de España y la de Illinois (EE. UU.). A pesar de ser regulaciones muy diferentes, los trabajadores son el denominador común y por ello la comparativa resulta interesante.

Además, se ha realizado una investigación sobre cuáles son las condiciones a las que los trabajadores de dichas empresas están sometidos. Para poder determinar el tipo de relación que mantienen dichos trabajadores con sus respectivas empresas, se parte del estudio de la regulación laboral y se añaden notas sobre las diferentes implicaciones que puede tener en otras áreas del Derecho.

Lo que se pretende con este trabajo es, a raíz de la investigación, elaborar una opinión fundada en Derecho, teniendo en cuenta las fuertes implicaciones que esto puede tener de cara al futuro de dichas empresas, sus trabajadores y el modelo económico en general.The purpose of this Dissertation is to study the independent contractors’ regulation under the Spanish and the Illinois (U.S.) legislation. Its main goal is to analyze the elements that compound the labor relation between the parties and the independent contractors’ regulations, regarding a reality: the start-ups that offer products and services through intermediaries.

This Dissertation studies and compares the labor legislation within the Spanish and the Illinois perspectives. Even though they differ, workers are the common ground and for that, the comparative is interesting.

Moreover, it focusses on the investigation of the labor conditions. The labor regulation is the theoretical element that determines the relation between the workers and their enterprises, taking into account the implications on other Law-areas.

This dissertation aims to elaborate a Law-based opinion, keeping in mind the strong and powerful implications this can provoke not only on the enterprises, but also on the workers and the economy in general.
