Abstract

La acción de petición de herencia es una figura del ordenamiento jurídico español sobre la cual no hay una regulación en nuestro ordenamiento. La jurisprudencia y la doctrina han sido las encargadas de definir la acción de petición de herencia y de interpretarla en los distintos casos. Debido a las dudas acerca de la naturaleza jurídica de la misma, ha existido, a lo largo de la historia, un debate acerca de donde encaja en nuestro ordenamiento jurídico. Siempre ha estado muy relacionada con la acción reivindicatoria, acción similar pero con diferencias notables.

Esta figura va de la mano de la figura del heredero aparente. El heredero aparente es aquel que parece ser el heredero legítimo pero no lo es. El heredero aparente puede serlo de buena o de mala fe.
