Los niños y niñas de las mujeres que migran solas a España : problemas jurídicos a la luz de la Convención de los Derechos del Niño

Abstract

En España existen miles de víctimas de trata de seres humanos que no son identificadas por las autoridades. Los últimos años parece haberse detectado un colectivo especialmente vulnerable a este delito: mujeres subsaharianas que migran a España en patera acompañadas de sus hijos menores y/o embarazadas. Tanto las mujeres como sus hijos son un colectivo especialmente vulnerable a quien el estado tiene la obligación de proteger pero, tristemente, los mecanismos de protección que ofrece nuestro sistema quedan lejos de garantizar la protección que necesitan.In Spain there are thousands of victims of human trafficking who are not identified by the authorities. In recent years, a group that seems to be particularly vulnerable to this crime has been detected: sub-Saharan women who migrate to Spain in a patera boat accompanied by their minor children and/or pregnant women. Both women and their children are a particularly vulnerable group that the state has an obligation to protect, but sadly, the protection mechanisms offered by our system fall far short of guaranteeing the protection they need.
