Hacia la consolidación de un derecho humano a un medio ambiente seguro

Abstract

En la actualidad, el vínculo entre los derechos humanos y el medio ambiente constituye uno de los aspectos fundamentales que deben abordarse para la correcta implementación de la Agenda 2030. Aunque en las últimas décadas la creciente preocupación por los problemas ambientales y efecto de estos en el bienestar del ser humano han puesto de manifiesto la importancia de reconocer un derecho humano a un medio ambiente sano y seguro, el estado de la cuestión sigue siendo incierto. Ante la importancia de este vínculo para el desarrollo sostenible, el presente trabajo pretende analizar si está habiendo una evolución hacia la consolidación del derecho humano a un medio ambiente seguro. Con este fin, se estudia su desarrollo a nivel internacional y nacional, así como su aplicación e interpretación en los sistemas regionales de derechos humanos europeo, africano e interamericano.The interaction between human rights and the environment is one of the fundamental aspects that must be addressed for the correct implementation of the 2030 Agenda. Although in recent decades the growing concern about environmental problems and their effect on human well-being has brought to light the importance of recognizing a human right to a healthy and safe environment, the status of this relation remains uncertain. Given the importance of the interaction for sustainable development, this study aims to analyze whether there is an evolution towards a universal recognition of a human right to a safe environment. For this purpose, it studies the interaction between human rights and the environment at the international and national level, as well as its application and interpretation by the European, African and Interamerican regional human rights systems.
