Las garantías constitucionales (tema 13)

Abstract

El texto aborda las garantías constitucionales de los derechos fundamentales en el marco de la Constitución Española de 1978, particularmente las previstas en el artículo 53. Se distingue entre tres niveles de protección. El primer nivel incluye los principios del Capítulo III del Título I, que orientan la acción de los poderes públicos. El segundo nivel abarca los derechos del Capítulo II, donde el principio de "reserva de Ley" y la intervención judicial garantizan la protección de los derechos. El tercer nivel, que incluye derechos fundamentales como los recogidos en los artículos 15 a 29, goza de un amparo especial, incluyendo el recurso de amparo ante el Tribunal Constitucional. El texto también aborda el papel del Defensor del Pueblo, regulado por la Ley Orgánica 3/1981, como un comisionado encargado de la defensa de los derechos fundamentales frente a las Administraciones públicas. Este alto comisionado puede intervenir, investigar, y proponer cambios, además de tener la facultad de interponer recursos de inconstitucionalidad y de amparo.
