La protección del propietario frente a ocupaciones ilegales

Abstract

El presente Trabajo de Fin de Grado analiza la protección jurídica del derecho de propiedad frente al fenómeno de la ocupación ilegal de inmuebles en el ordenamiento jurídico español. Para ello, se examina el marco constitucional del derecho de propiedad y su relación con el derecho a una vivienda digna, estudiando la evolución doctrinal y jurisprudencial de ambos derechos y los límites derivados de la función social de la propiedad.

Tras el estudio del marco constitucional, se analizan los mecanismos civiles de protección del propietario frente a la ocupación ilegal, con especial referencia a la acción reivindicatoria, el desahucio por precario y la tutela sumaria de la posesión. Asimismo, se examinan las principales novedades introducidas por la Ley 5/2018, de 11 de junio, orientadas a agilizar la recuperación posesoria de viviendas ocupadas ilegalmente y a reforzar la tutela judicial de los titulares legítimos.

Seguidamente, se aborda la respuesta penal prevista por el ordenamiento jurídico, distinguiendo entre los delitos de allanamiento de morada y usurpación de bienes inmuebles, así como los principales criterios interpretativos desarrollados por la jurisprudencia. Finalmente, se valoran críticamente los problemas prácticos que continúan existiendo en la recuperación efectiva de la posesión y se exponen las principales conclusiones derivadas del estudio.

This Final Degree Project examines the legal protection of property rights against the unlawful occupation of real estate under Spanish law. To this end, it analyses the constitutional framework of property rights and their relationship with the right to adequate housing, focusing on the doctrinal and judicial evolution of both rights and the limits arising from the social function of property.

Following the constitutional analysis, the study examines the civil remedies available to property owners, with particular attention to the recovery action, eviction proceedings based on precarious occupation and summary possessory protection. It also analyses the main innovations introduced by Act 5/2018 of 11 June, aimed at facilitating the recovery of unlawfully occupied dwellings and strengthening judicial protection for legitimate possessors.

The paper then addresses the criminal regulation of unlawful occupation, distinguishing between the offences of trespass to a dwelling and unlawful occupation of real property, as well as the principal interpretative criteria established by Spanish case law. Finally, the study assesses the practical difficulties that still affect the effective recovery of possession and sets out the main conclusions reached.
