Abstract

En España, el fondo de comercio financiero se podía amortizar contablemente y deducirse fiscalmente, sin embargo, determinados parlamentario plantearon ante la Comisión Europea que esta medida se debía calificar como ayuda de Estado incompatible con el mercado común y, por tanto, ilegal. Después de dos decisiones de la Comisión y la interposición de diferentes recursos ante el Tribunal General y ante el Tribunal de Justicia, la situación no ha terminado de resolverse.
In Spain, the financial goodwill could be amortized for accounting purposes and deducted fiscally, however, a member of parliament raised before the European Commission that this measure could be classified as State aid incompatible with the common market and, therefore, illegal. After two Commission decisions and the filing of different appeals before the General Court and before the Court of Justice, the situation has not been fully resolved.
