Protección internacional de nacionales venezolanos en España: La justicia administrativa en desafío a la parálisis de la Administración migratoria. Decisión de vanguardia.

Abstract

Este informe presenta el proceso que ha conducido al otorgamiento de protección internacional de nacionales venezolanos solicitantes de Asilo en España, ante la indecisión y negativa de acordarles Asilo por la Administración migratoria. Destacamos el contexto de crisis humanitaria en Venezuela y la migración forzada de su población, con las cifras de solicitudes. Describimos las decisiones de la Administración y de los tribunales en este largo camino para proteger los derechos humanos de estos venezolanos solicitantes de protección internacional en España. Se valora especialmente la decisión vanguardista de la Justicia Administrativa de abrir la puerta, previo el descarte del Asilo y la protección subsidiaria, a la figura de residencia por razones humanitarias.This report presents the process that has led to the granting of international protection of Venezuelan national asylum seekers in Spain, given the indecisiveness and refusal to agree to asylum by the immigration administration. We emphasize the context of humanitarian crisis in Venezuela and the forced migration of its population, with the figures of applications. We describe the decisions of the administration and the courts in this long way to protect the human rights of these Venezuelan applicants for international protection in Spain. It is particularly valued the avant-garde decision of the administrative justice to open the door, before the discard of the asylum and the subsidiary protection, to the figure of residence for humanitarian reasons.
