La transición hacia el futuro umbral legal máximo de jornada. Reflexiones en torno al blindaje legal

Abstract

El capítulo analiza la transición hacia la futura reducción de la jornada máxima legal a 37,5 horas semanales en cómputo anual y centra la atención en el llamado “blindaje legal” previsto en el anteproyecto. La autora sostiene que la adaptación será compleja por la diversidad de situaciones empresariales, el marco multinivel de fuentes laborales y el impacto organizativo y económico de la reforma. Examina las vías de ajuste mediante negociación colectiva, acuerdos de empresa, pactos individuales y decisiones unilaterales empresariales, así como sus límites jurídicos. Su tesis principal es que el blindaje protege salarios y condiciones favorables durante la transición, pero no de forma absoluta ni perpetua. Propone aclarar técnicamente el alcance temporal, subjetivo y material de esa garantía para evitar conflictividad, desequilibrios interpretativos y una litigiosidad elevada.The chapter examines the transition toward the future statutory reduction of maximum working time to an average of 37.5 hours per week and focuses on the proposed legal “shielding” of workers’ rights. The author argues that implementation will be complex because of the diversity of company situations, the multilevel system of labour-law sources, and the organisational and economic effects of the reform. She reviews the possible adjustment mechanisms through collective bargaining, company agreements, individual arrangements, and unilateral employer decisions, together with their legal limits. Her main conclusion is that the legal shield protects wages and favourable conditions during the transition, but neither absolutely nor permanently. The chapter calls for clearer legislative drafting on the temporal, subjective, and material scope of this safeguard in order to reduce uncertainty and future litigation.
