Abstract

El presente Trabajo de Fin de Grado analiza de manera sistemática las principales cues-tiones jurídicas que suscita el derecho de transmisión —regulado en el artículo 1006 del Código Civil— y su relación con las sustituciones testamentarias. A pesar de su aparente sencillez nor-mativa, el derecho de transmisión ha generado un intenso debate doctrinal y jurisprudencial en torno a su naturaleza jurídica, su funcionamiento y sus efectos sobre la delación hereditaria. En este contexto, se estudian la teoría clásica y la teoría moderna, así como la consolidación juris-prudencial, que redefine la comprensión del fenómeno sucesorio cuando fallece un heredero sin aceptar ni repudiar la herencia del primer causante. El trabajo también aborda las principales cuestiones jurídicas detectadas tanto en suce-sión testada como intestada, a través del análisis de resoluciones de la Dirección General de Seguridad Jurídica y Fe Pública (DGSJFP) y de la jurisprudencia reciente. Asimismo, se exa-mina la relación entre el ius transmissionis y diversas modalidades de sustitución testamentaria —principalmente la vulgar—, evaluando cómo estas instituciones pueden operar de forma complementaria o conflictiva. Finalmente, se plantean posibles soluciones interpretativas y pro-puestas de lege ferenda que permitan reforzar la seguridad jurídica en esta materia

This Final Degree Project provides a systematic analysis of the main legal issues raised by the right of transmission—regulated under Article 1006 of the Spanish Civil Code—and its relationship with testamentary substitutions. Despite its apparent normative simplicity, the right of transmission has generated significant doctrinal and jurisprudential debate regarding its legal nature, operation, and effects on the devolution of the estate. In this context, both the classical and modern theories are examined, along with the consolidation of case law, which has redefined the understanding of the succession process when an heir dies without having accepted or repudiated the inheritance of the original decedent.

The study also addresses the main legal issues identified in both testate and intestate succession through the analysis of decisions issued by the Directorate-General for Legal Security and Public Faith (DGSJFP) and recent case law. Furthermore, it explores the relationship between the ius transmissionis and various forms of testamentary substitution—particularly substitution vulgaris—assessing how these institutions may operate either in a complementary or conflicting manner. Finally, the paper proposes interpretative solutions and de lege ferenda recommendations aimed at enhancing legal certainty in this area.
