IMPACTO Y PERSPECTIVAS DE LAS SOCIEDADES PARA EL BENEFICIO Y EL INTERÉS COMÚN EN EL ENTORNO EMPRESARIAL ESPAÑOL: COMPARACIÓN CON LA CERTIFICACIÓN B CORP

Abstract

La creciente preocupación por el impacto del crecimiento económico en el medioambiente y en la sociedad busca transformar el panorama empresarial en uno mucho mas consciente de estas cuestiones. La Ley “Crea y Crece” sobre creación y crecimiento de empresas introdujo en su enmienda transaccional la figura de la Sociedad para el Beneficio y el Interés Colectivo, como figura jurídica que da soporte a las empresas sociales. Esta novedad ya ha sido implantada en otros países como Perú, Francia, Italia y Estados Unidos por iniciativa de la empresa B Lab. Es por ello que este Trabajo de Fin de Grado analiza y compara las SBIC con la Certificación B Corp en España con el fin de evaluar si el modelo de las SBIC proporciona un marco más concreto e integral. Además, trata de explorar el impacto que estas figuras jurídicas han tenido respecto al resto incluyendo una exploración de las características principales de las empresas que adoptan este tipo de sociedades.The growing concern for the impact of economic growth on the environment and society seeks to transform the business landscape into one that is much more aware of these issues. The “Crea y Crece" Law on the creation and growth of companies introduced in its transactional amendment the figure of the "Sociedad para el Beneficio y el Interés Colectivo", as a legal figure that supports social enterprises. This novelty has already been implemented in other countries such as Peru, France, Italy and the United States through the initiative of the company B Lab. That is why this Final Degree Project analyzes and compares SBICs with B Corp Certification in Spain in order to assess whether the SBIC model provides a more concrete and comprehensive framework. In addition, it attempts to explore the impact that these legal entities have had on the rest, including an exploration of the main characteristics of the companies that adopt this type of company.
