La inteligencia artificial como desafío a la protección de los derechos fundamentales.

Abstract

Este Trabajo de Fin de Grado aborda el estudio del impacto de la inteligencia artificial en el marco de los derechos fundamentales recogidos en la Constitución Española. Se parte del análisis de cada uno de los derechos fundamentales afectados por el auge de la inteligencia artificial. Se destaca la prevalencia que está adquiriendo esta nueva tecnología así como su impacto en áreas de gran importancia como son la protección de datos, la dignidad y el trabajo y la privacidad. Esta concepción global se vuelve crucial en la era digital donde cada vez esta inteligencia puede manipular la realidad de forma altamente convincente. Se debe crear un balance entre los derechos fundamentales y la evolución tecnológica. Finalmente, se responde a la pregunta sobre como la inteligencia artificial puede influir en los derechos fundamentales, destacando la posibilidad de vulneraciones y por ende, la importancia de considerar todos los factores relevantes y las medidas legales pertinentes.This Paper analyses the impact of artificial intelligence within the framework of the fundamental rights enshrined in the Spanish Constitution. It begins with a systematic examination of the fundamental rights affected by the surge of artificial intelligence. Particular attention is paid to the increased presence of this technology and its implications for pivotal areas such as human dignity, labor, data protection and privacy. This approach is essential in this new digital era where artificial intelligence is increasingly capable of manipulating reality to suit its preferences through highly sophisticated and convincing manners. The need to strike the adequate balance between the protection of human rights and the ongoing technological development becomes paramount. Finally, this paper addresses the departing premise of how artificial intelligence may influence fundamental rights and the potential infringements that may arise. It therefore underscores the importance of honing in all relevant factors and implementing the necessary legal safeguards.
